These Terms of Use ("Terms") are a legal agreement between you and Baristafy, LLC, a Wisconsin limited liability company ("Baristafy," "we," "us," or "our"), governing your access to and use of the website baristafy.coffee, the Baristafy mobile application, and related services (together, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement and that all registration information you submit is accurate and truthful.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use of your account.

3. User Content and Reviews

The Service allows you to submit reviews, ratings, photos, comments, and other content ("User Content") about coffee products and businesses. By submitting User Content, you grant Baristafy a non-exclusive, worldwide, royalty-free, transferable license to use, host, store, reproduce, display, and distribute that content in connection with operating and promoting the Service.

You are solely responsible for your User Content. You agree not to post content that is false, defamatory, slanderous, harassing, unlawful, or that infringes the rights of others. Baristafy cannot be held liable for slanderous or otherwise unlawful content submitted by a user, and you understand and agree that you may be personally subject to legal repercussions, including civil liability, for slanderous, defamatory, or other malicious or unlawful posts you submit.

We may, but are not obligated to, monitor, remove, or refuse to display User Content that we believe violates these Terms or applicable law.

4. Prohibited Conduct

You agree not to: (a) post false, misleading, defamatory, or malicious reviews; (b) impersonate any person or entity; (c) interfere with or disrupt the Service; (d) attempt to access accounts or data that are not yours; (e) use the Service for any unlawful purpose; or (f) scrape or harvest data from the Service without our written permission.

5. Location Services

If you use our mobile app, certain features (such as finding nearby cafes) rely on access to your device's location. Providing this permission is optional; you may enable or disable it at any time in your device settings.

6. Businesses and Advertisers

Businesses may claim listings, respond to reviews, or purchase advertising or promotional placements through the Service, subject to any additional terms presented at the time. Business features do not entitle any business to remove, alter, or suppress a truthful, non-violating user review.

7. Intellectual Property

The Service, including its design, text, graphics, logos, and software (excluding User Content), is owned by Baristafy or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service except as expressly permitted.

8. Third-Party Services and Links

The Service may link to or integrate with third-party websites or services (such as Google Sign-In). We do not control and are not responsible for third-party content, products, or services.

9. Disclaimer of Warranties

THE SERVICE AND ALL USER CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. BARISTAFY DOES NOT WARRANT THAT REVIEWS OR OTHER USER CONTENT ARE ACCURATE, RELIABLE, OR TRUTHFUL.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BARISTAFY, LLC AND ITS OWNERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR REPUTATION, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR ANY USER CONTENT, INCLUDING ANY DEFAMATORY, SLANDEROUS, OR OTHERWISE UNLAWFUL CONTENT POSTED BY ANY USER. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).

11. Indemnification

You agree to indemnify and hold harmless Baristafy, LLC and its owners, members, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of the Service, your User Content, or your violation of these Terms or any law or third-party right.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to the Service, other users, or businesses. You may stop using the Service and delete your account at any time.

13. Changes to These Terms

We may revise these Terms from time to time. If we make material changes, we will update the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Wisconsin, and you consent to the personal jurisdiction of those courts.
